Limited warranty
Giesemann
Lichttechnik 14 burdestrasse, Nettetal Germany D-43314, (hereinafter called
"Giesemann") Warrants to the purchaser that its products (hereinafter called
"Lighting Products") will be free from defects in material and workmanship for
the specified warranty periods beginning from the date of purchase. The warranty
period is 12 months and the manufactured date is on the Lighting Products
warranty cards. No warranty is granted in regards of the Metal halide bulbs
unless a clear and evident defect is demonstrated
If it appears within the specified warranty period that a Giesemann lighting
Products does not meet the warranty specified above, AC, at its option, will
either repair or replace the Lighting Product at Giesemann expense. Giesemann
extends the limited warranty to the original or first end-user purchaser only.
This warranty is conditional based upon proper storage, installation, use and
maintenance.
This warranty is not applicable to, and Giesemann makes no warranty whatsoever
with respect to, any Lighting Product not installed and operated in accordance
with it’s operation manual or for any other uses not related with the decorative
or scientific aquarium industry. Nor is this warranty applicable to any Lighting
Products which has been installed and operated in accordance with Giesemann
specifications and connection diagrams or Lighting Products, which have been
subjected to abnormal operating conditions. This includes, but is not limited
to, excessive temperatures. The conditions for any tests(to be) performed on
Lighting Products which are claimed to have not performed in accordance with the
terms of the warranty shall be mutually agreed upon in writing and Giesemann may
be represented at any such time.
NO
IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE SHALL
APPLY BEYOND THE AFOREMENTIONED WARRANTY PERIOD.
The foregoing warranty is exclusive of all other statutory, written or oral
warranties and no other warranties of any kind, statutory or otherwise, are
given or herein expressed. Warranty claims are to be made in accordance with
Giesemann published Warranty Procedure which is available upon request or on our
web site at
www.giesemann.de . This warranty sets forth Giesemann obligations and
responsibilities regarding its Lighting Products and is the exclusive remedy
available to the claimant.
LIMITATIONS OF LIABILITY,
Under no circumstances, whether as a result of breach of contract, breach of
warranty, tort, strict liability or otherwise, will Giesemann will liable for
consequential, incidental, special or exemplary damages, including, but not
limited to, loss of profits, loss of use or damage to any property or equipment,
cost of capital, cost of substitute product, facilities or services, down time
costs or claims of claimant's customers. Giesemann liability for all claims of
any kind or for any loss or damages arising out of, resulting from or concerning
any aspect of this warranty or from the Lighting Products hereunder shall not
exceed the price of the specific Lighting Product which give right to the claim.
STATE LAW RIGHT, Some
states do not allow the exclusion or limitation of consequential or incidental
damages or the duration of time for an implied warranty. Therefore, the
limitations or exclusions of consequential or incidental damage and implied
warranties may not apply to certain claimants. This warranty provides the
claimant with specific legal rights and claimants may have other rights that
vary from state to state.
PROCEDURE FOR
WARRANTY RETURNS
1.
All
products being returned to a
Giesemann authorized service point must obtain an
RAN (Return Authorization
Number) number from the company. You can obtain this number by using any of the
following options:

2.
You
will need to provide the following information:
a) Primary purchase source.
b) Item number of unit(s) and model description being returned.
c) Contact person and phone number at installation site.
d) Nature of problem
e) Lot number of the products (Shown on warranty card).
f) Type of lamp (bulb) used with the lighting product
g) Copy of the invoice
3. Once the above has been established, and at the discretion of Giesemann, we will either replace, refund or credit your account. If Giesemann deems a field site visit necessary, we will arrange for a staff engineer or authorized Giesemann agent to do an on-site inspection of the problem. When problematic lighting product is returned for inspection, we may require that the lamps be returned as well as the fixture -- to ensure complete testing results (this will not be necessary in all cases).
4. If replacement product is needed immediately, you will be billed for the replacement via credit card or C.O.D., unless credit approval has been given. A refund or credit will be issued for the returned product. In all cases, warranty labor arrangements will be made by Giesemann or Xenia North America Inc.. Only with prior written approval will labor allowance be reimbursed, if contracted by the consumer without Giesemann approval.
